1. Overview

This Privacy Policy explains how BookJerseyShore LLC ("Company," "we," "us," or "our") collects, uses, shares, and protects information when you use the Book Jersey Shore platform (the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to this Privacy Policy. This Policy is incorporated into and subject to our Terms of Service.

2. Information We Collect

We collect the following categories of information:

a. Information You Provide

  • Account information: name, email address, phone number, and password.
  • Profile and listing data: property addresses, descriptions, photos, pricing, availability, and house rules.
  • Contract and booking data: rental agreement terms, booking dates, amounts, payment schedules, payment instructions, payment-status notes, and special conditions.
  • Electronic signature data: signature images (drawn or typed), legal names, consent records, external signer contact information, and signing metadata (IP address, timestamp, user agent, consent version).
  • Identity verification data: government-issued identification documents or verification metadata, when submitted voluntarily.
  • Points, referral, and promotion data: point balances, ledger entries, referral codes, referral attribution, milestone status, founding-offer claims, promotion eligibility, and support corrections.
  • Reviews, reports, and moderation data: reviews, replies, ratings, reports, report reasons, moderation actions, edit history, and point reversals tied to review moderation.
  • Communications: messages sent through the Platform, support requests, payment-coordination notes, and dispute records.

b. Information Collected Automatically

  • Device and usage data: IP address, browser type and version, operating system, device identifiers, pages viewed, access times, and referring URLs.
  • Cookies and similar technologies: session cookies and functional cookies as described in our Cookie Policy.
  • Log data: server logs, error reports, and performance metrics.

c. Information from Third Parties

  • Payment processors: if payment processing is enabled, transaction status, last four digits of payment methods, payout confirmation, dispute status, and processor onboarding status from services such as Stripe.
  • Identity verification services: verification results and confidence scores.
  • Referral and campaign sources: referral codes, campaign parameters, landing-page source information, and related attribution data.

3. How We Use Information

  • Operate the Platform and manage accounts, listings, bookings, and contracts.
  • Facilitate the creation, execution, and storage of rental agreements and electronic signatures.
  • Verify identities, reduce fraud, and support trust and safety.
  • Display payment instructions and payment-tracking records in connection with bookings (the Company does not store full payment credentials).
  • Operate platform points, founding offers, referrals, rewards, promotional grants, and support corrections.
  • Operate reviews, replies, reports, moderation, and trust-safety workflows.
  • Provide customer support and facilitate dispute resolution.
  • Send service-related communications, including account notifications, booking confirmations, contract updates, and security alerts.
  • Send marketing communications where you have opted in (you may opt out at any time).
  • Improve the Platform through analytics, usage research, and product development.
  • Develop aggregated, anonymized, or de-identified datasets for analytics, research, benchmarking, and commercial purposes.
  • Comply with legal obligations, enforce our Terms, and protect the rights, property, or safety of the Company, its Users, or the public.

4. How We Share Information

  • Between Hosts and Guests: When you enter into a booking, inquiry, contract, payment-coordination flow, external signing flow, review flow, or related stay workflow, relevant information (such as name, email, phone number, booking details, contract details, payment instructions, payment-tracking notes, signatures, and review content) may be shared with the counterparty to fulfill the transaction and preserve the record.
  • Service providers: We share information with third-party vendors that help us operate the Platform, including communication services, hosting providers, analytics tools, identity verification vendors, and, if enabled, payment processors such as Stripe, subject to contractual confidentiality obligations where appropriate.
  • Legal and safety purposes: We may disclose information to respond to lawful requests, court orders, subpoenas, or government investigations; to protect the rights, property, or safety of the Company, its Users, counterparties, or the public; to investigate fraud, abuse, safety incidents, or disputes; or to enforce our Terms and policies. Verification materials may be disclosed to counterparties or authorities only when reasonably necessary for a real booking, signed contract, dispute, safety issue, legal process, or rights-protection purpose.
  • Business transfers: In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of Company assets, your information may be transferred as part of that transaction. We will notify you of any such transfer and any choices you may have.
  • Aggregated and anonymized data: We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you, without restriction.

We do not sell your personal information to third parties for their direct marketing purposes.

5. Payments

During the current launch period, Hosts and Guests pay each other directly using the instructions they agree to. The Platform may display payment instructions and payment-tracking records, but those records are documentation aids and do not mean the Company processed or verified payment.

If third-party payment processing is enabled later, processing will be handled by providers such as Stripe. We do not store full payment card numbers or bank account details. Payment processors may collect tax identification numbers or verification information to comply with their legal obligations (including 1099-K reporting). 6. Data Retention

We retain personal information for as long as necessary to provide the Platform, fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Contract and transaction records may be retained for extended periods as required by law or for legitimate business purposes, including legal recordkeeping and audit requirements.

Post-Deletion Retention. When you delete your account, the following data is retained for six (6) years to comply with applicable statutes of limitations for contract actions (specifically N.J.S.A. 2A:14-1, which governs the jurisdiction where the Platform's rental transactions primarily occur) and to protect the legal rights of the Company and counterparties to executed agreements:

  • Contract content, signed PDFs, and signature records (including signer identity, timestamp, and signature images).
  • E-SIGN consent records (IP address, user agent, consent timestamp, and disclosure version).
  • Identity verification materials (such as government ID photos submitted during verification) when associated with executed rental agreements, disputes, investigations, safety incidents, fraud prevention, or legal obligations.
  • Transaction and booking history associated with executed rental agreements.
  • Payment instructions, payment-tracking notes, and payment-status records associated with executed rental agreements.
  • Review, report, and moderation records associated with completed stays, disputes, or enforcement actions.
  • Terms of Service acceptance records.

After the six-year retention period, retained data will be anonymized or deleted. General account data not associated with executed contracts, disputes, investigations, safety incidents, fraud prevention, or legal obligations (such as draft listings or incomplete bookings) will be removed or anonymized in the ordinary course following deletion. Anonymized or aggregated data may be retained indefinitely.

If you re-register with the same email address after deleting your account, previously retained contract and booking records may be reassigned to your new account to ensure continuity of legal obligations and access to prior agreements.

7. Cookies and Tracking

We use cookies and similar technologies to keep you signed in, remember preferences, and understand how the Platform is used. We do not currently use third-party advertising or ad-tracking cookies. See our Cookie Policy for details.

8. Your Rights and Choices

Depending on your jurisdiction, you may have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete personal information.
  • Delete your personal information, subject to legal retention requirements.
  • Opt out of marketing communications by following the unsubscribe instructions in any marketing message or by contacting us.
  • Manage cookies through your browser settings.

9. Security

We use administrative, technical, and physical safeguards to protect your information, including encrypted connections (TLS), hashed passwords, access controls, and secure server infrastructure hosted in the United States. No method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security and are not liable for unauthorized access resulting from circumstances beyond our reasonable control.

10. Children

The Platform is not intended for children under the age of thirteen (13). We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete it or otherwise handle it in accordance with applicable law.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated "Last updated" date, and we may provide additional notice through the Platform or by email. Your continued use of the Platform after any changes constitutes acceptance of the revised Policy.

12. International Users

The Platform is operated in the United States and data is stored on servers located in the United States. If you access the Platform from outside the United States, you consent to the transfer, processing, and storage of your information in the United States, where data protection laws may differ from those in your jurisdiction.
